Terms of Use

The short version

Mixtape turns your story into a song for someone you love. Be kind with what you share, only share what's yours to share, and enjoy the song. These terms are an agreement between you and Clutch Labs, Inc. (“we”, “us”). By using Mixtape you agree to them.

Using Mixtape

• You need to be at least 13 to use Mixtape. If you're under 18, please use it with a parent or guardian's permission.
• Use Mixtape for personal gifts and keepsakes, and follow the law while you do.
• Don't try to break, overload, copy or misuse the service, or get around its limits.

What you share

Your story, names and notes stay yours. You let us use them only to write, record and deliver your song (see our Privacy Policy). Please don't share anything that:

• isn't yours to share, or that someone wouldn't want shared;
• is hateful, harassing, threatening or meant to hurt or embarrass someone;
• is sexual content involving anyone under 18, or otherwise illegal;
• copies someone else's lyrics or impersonates a real artist.

We may decline to make a song, or remove one, if it breaks these rules.

Your song

Each song is created fresh from what you share, using automated (AI) music and lyric technology. You may keep it, play it, give it to the person it's for, and share it with friends, family and on social media.

Songs are for personal, non-commercial use: please don't sell them, release them on streaming services, or use them in ads. Because songs are generated, we can't promise one will never sound like another piece of music, and the lyrics are only as accurate as the story you give us.

Purchases

• Making a song and hearing a preview is free. Unlocking the full song and extra remakes are one-time in-app purchases; prices are shown in the app before you buy.
• Purchases are made through the App Store (or Google Play) and are subject to their terms. Refund requests go through Apple at reportaproblem.apple.com (or Google).
• Every song includes one free remake. Promo codes are subject to the terms of their offer.

Share links

Unlocked songs get a private link. Anyone you give the link to can open it, so share it with care. We may remove share pages that break these terms.

The fine print

Mixtape is provided “as is”. We work hard to keep it running and to make songs you'll love, but we can't guarantee it will always be available or error-free, or that every song will be to your taste. To the extent the law allows, we aren't liable for indirect or consequential losses, and our total liability for any claim is limited to what you paid us for the song in question.

We may update Mixtape and these terms. If we make important changes we'll update the date above; continuing to use Mixtape means you accept them.
